TERMS OF SERVICE AND END USER LICENSE AGREEMENT (EULA)

1. ACCEPTANCE OF TERMS
Welcome to the AI Focus Timer & Music ADHD mobile application (the “App”), developed, operated, and maintained by WRS Group SRL (“we,” “us,” our,” or the “Company”), a company incorporated under the laws of Romania.
By downloading, accessing, installing, or using the App, you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service and End User License Agreement (the “Terms”). If you do not agree to these Terms, you must not access or use the App and must delete it from your device immediately.
These Terms constitute a binding legal agreement between you and WRS Group SRL. Your use of the App is also subject to our Privacy Policy.
2. NATURE OF THE SERVICE & ACADEMIC BACKGROUND
The App provides productivity tools, including but not limited to task deconstruction, timer functionalities, and adaptive background audio. The App incorporates the Open Foresight framework, which is based on academic PhD research in cognitive learning improvement, and utilizes proprietary Agentic AI frameworks to assist users in managing tasks.

3. EXPLICIT MEDICAL AND HEALTH DISCLAIMER
3.1 Not a Medical Device: The App is a productivity and educational tool designed to assist with focus and task management. It is NOT a medical device, nor is it intended to diagnose, treat, cure, mitigate, or prevent ADHD (Attention-Deficit/Hyperactivity Disorder) or any other cognitive, psychological, or medical condition.
3.2 No Professional Medical Advice: The content, AI-generated suggestions, and audio features provided within the App do not constitute professional medical, psychiatric, or psychological advice. You should never delay seeking medical advice, disregard medical advice, or alter any medical treatment because of information provided by the App.
3.3 Assumption of Risk: You assume all risks associated with the use of the App. WRS Group SRL shall not be liable for any physical or mental distress, lack of productivity, or exacerbation of any condition resulting from the use of the App.
4. ARTIFICIAL INTELLIGENCE AND GENERATIVE CONTENT DISCLAIMER
4.1 AI Limitations: The App utilizes advanced third-party Artificial Intelligence integrations and proprietary models to perform “Task Slicing” and provide recommendations. You acknowledge that generative AI is a rapidly evolving technology. The AI-generated content may be inaccurate, incomplete, misleading, or contextually inappropriate (“hallucinations”).
4.2 No Endorsement: The AI’s suggestions do not represent the views or advice of WRS Group SRL.
4.3 User Verification: You are solely responsible for reviewing, verifying, and deciding whether to act upon any task breakdowns or advice generated by the AI integrations. We expressly disclaim any liability for any actions taken or not taken based on AI-generated content.
5. SUBSCRIPTIONS, PURCHASES, AND BILLING
5.1 Freemium Model: The App operates on a freemium model. Certain features are provided free of charge, while premium features (such as unlimited AI Task Slicing) require a paid subscription (“Premium Plan”).
5.2 In-App Purchases: All subscriptions and in-app purchases are processed securely through the Apple App Store (via Apple Inc.). We do not directly collect or store your credit card information.
5.3 Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
5.4 Cancellations and Refunds: You may manage or cancel your subscriptions by going to your Apple ID Account Settings after purchase. Because the billing is handled entirely by Apple, WRS Group SRL cannot process refunds. All refund requests must be directed to Apple Support in accordance with Apple’s refund policies.
5.5 Price Changes: We reserve the right to adjust pricing for our Premium Plans at any time. Any price changes will be communicated to you by Apple and will take effect at the start of the next subscription period.
6. LICENSE TO USE THE APP
6.1 Limited License: Subject to your strict compliance with these Terms, WRS Group SRL grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a compatible mobile device that you own or control, solely for your personal, non-commercial use.
6.2 Restrictions: You agree NOT to:
(a) Modify, translate, adapt, or create derivative works from the App;
(b) Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App or its AI integrations;
(c) Rent, lease, sell, redistribute, or sublicense the App;
(d) Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices;
(e) Use the App to generate content that is unlawful, harmful, defamatory, or violates third-party rights;
(f) Use automated systems (bots, scrapers) to extract data from the App.
7. INTELLECTUAL PROPERTY RIGHTS
All rights, title, and interest in and to the App, including all software, source code, designs, text, graphics, audio layers, AI prompts, algorithms, and the “Open Foresight” methodology, remain the exclusive property of WRS Group SRL and its licensors. These are protected by international copyright, trademark, and intellectual property laws. No ownership rights are transferred to you under these Terms.
8. USER ACCOUNTS AND DATA
8.1 Registration: If you create an account (via Google, Apple, or email), you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
8.2 User Input: You retain ownership of the tasks and text you input into the App. By submitting input, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and transmit this data for the sole purpose of operating the App and generating AI responses via our AI integrations.
8.3 Privacy: Our collection and use of personal data are governed by our Privacy Policy. By using the App, you consent to data processing as described therein.
9. DISCLAIMER OF WARRANTIES
THE APP AND ALL CONTENT, AI RECOMMENDATIONS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WRS GROUP SRL DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, BUG-FREE, SECURE, OR FREE OF VIRUSES, OR THAT THE AI OUTPUT WILL BE ACCURATE OR RELIABLE.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WRS GROUP SRL, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, INTERRUPTIONS IN PRODUCTIVITY, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP;
(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY OR AI ENGINE WITHIN THE APP;
(C) ANY ACTION TAKEN BASED ON AI-GENERATED TASK SLICING OR ADVICE.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP EXCEED THE AMOUNT YOU PAID, IF ANY, TO US FOR THE APP DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR FIFTY EUROS (€50), WHICHEVER IS GREATER.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless WRS Group SRL, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:
(a) Your use of and access to the App;
(b) Your violation of any term of these Terms;
(c) Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
12. THIRD-PARTY SERVICES AND APPLE TERMS
12.1 Apple App Store: You acknowledge that these Terms are concluded between you and WRS Group SRL only, and not with Apple Inc. WRS Group SRL, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
12.2 Third-Party Beneficiary: Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
13. GOVERNING LAW AND JURISDICTION
These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms, including disputes relating to their validity, interpretation, or termination, shall be subject to the exclusive jurisdiction of the competent courts of Bihor County, Romania. If you are an EU consumer, you may also have the right to bring proceedings in your country of residence under mandatory consumer protection laws.
14. CHANGES TO THESE TERMS
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify users of significant changes by updating the “Last Updated” date at the top of these Terms and, where appropriate, via an in-app notification. Your continued use of the App following the posting of any changes constitutes acceptance of those changes.
